Terms of Service
1) Acceptance
By accessing or using PHOTOHAUS (the “Platform”), you agree to these Terms. If you do not agree, do not use the Platform.
2) Accounts
- You are responsible for maintaining the confidentiality of your account and password.
- You must provide accurate information and keep it up to date.
- You must be at least the age of majority in your jurisdiction to use the Platform.
3) Uploads & Content Rules
- You may upload only content you own or have permission to license and sell.
- Prohibited: illegal content, pornography/explicit sexual content, hate/harassment, and content that infringes others’ rights.
- We may review, approve, reject, or remove content at our discretion (including for policy or quality reasons).
4) License & Copyright
- Creators retain copyright in their works unless separately agreed.
- Buyers receive a limited license for personal and/or commercial use as described on the item page.
- Resale, redistribution, or re-uploading of purchased files is prohibited.
5) Pricing, Platform Fee, and Payouts (Creators)
Creators may set prices in USD (beta). The Platform may display prices, promotions, or tax information depending on the buyer’s location.
For each completed sale of your digital content on PHOTOHAUS, you agree that PHOTOHAUS charges a 30% platform commission on the sale amount (the “Platform Fee”). The Platform Fee is deducted from the buyer’s payment before payout. The remaining amount (net of the Platform Fee) is your creator earnings, subject to any applicable taxes, chargebacks, refunds, and payment processing costs (if/when payment processing is enabled).
- In beta, payouts may be settled manually and may require your payout/bank details in My Page.
- For international transfers, bank fees may be handled as “BEN” (recipient-borne), unless stated otherwise.
- PHOTOHAUS may delay or withhold payouts to investigate fraud, chargebacks, disputes, or policy violations.
6) Digital Content Delivery
Digital items are delivered via download (or other digital delivery methods). You are responsible for ensuring your device and network can receive the content.
7) Refund & Cancellation Policy (Digital Content)
Because items are digital content, refunds/cancellations are limited once delivery begins.
- No refund after download/access: In general, once a digital file is downloaded or accessed, the purchase is final.
- Exception — platform error: If delivery fails due to a platform error, PHOTOHAUS may, at its discretion, re-deliver the content or issue a partial/full refund.
- Exception — duplicate charge / fraud: If you were charged twice or there is confirmed unauthorized payment, we will review and may refund.
- Disputes/chargebacks: A buyer chargeback may result in reversal of the sale and related creator earnings.
8) Alternative Compensation (Beta)
In certain cases (beta testing, promotions, disputes, or platform issues), PHOTOHAUS may provide non-monetary compensation such as platform credits or coupons. These do not constitute cash refunds unless explicitly stated.
9) Limitation of Liability
The Platform is provided “as is.” PHOTOHAUS is not liable for indirect or consequential damages arising from use of the Platform, to the maximum extent permitted by law.
10) Governing Law
These Terms are governed by the laws of the Republic of Korea, unless otherwise required by applicable law.
